PURPOSE

The purpose of this resolution is to authorize the Mayor to execute an amendment to a lease agreement with Oil & Ale HCB, LLC, to provide space for the Police Department Internal Affairs Unit retroactive from January 1, 2012 through December 31, 2016.

BACKGROUND INFORMATION

The Police Department has a special unit charged with investigating citizen complaints against police officers. This Unit was originally located in the police department headquarters building until 2004, when the U. S. Department of Justice recommended that it be located away from the headquarters building. The Internal Affairs Unit was moved across the street to the City Hall Annex Building on Murphy Street. In 2006, the police department was notified there were plans to demolish the City Hall Annex and the Unit would need to be housed elsewhere. At that time, a suitable space of approximately 2,131 square feet was located at 400 Travis Street, Suite 1412, Shreveport, Louisiana. That space was leased and the Unit was relocated in November of 2006. The original lease expired on December 31, 2011. The owners of the building have provided an amendment to the original lease to continue leasing the space beginning January 1, 2012 through December 31, 2016.

RESOLUTION NO. ________ OF 2012

A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AN AMENDMENT TO A LEASE AGREEMENT WITH OIL & ALE HCB, LLC, AND OTHERWISE PROVIDING WITH RESPECT THERETO

BY:

WHEREAS, the City of Shreveport Police Department currently operates and maintains an Internal Affairs Unit located at 400 Travis Street, Suite 1412, Shreveport, Louisiana, which is owned by Oil & Ale HCB, LLC,; and

WHEREAS, the original lease between the parties became effective August 16, 2006 and expired on December 31, 2011; and

WHEREAS, Oil & Ale HCB, LLC has proposed a ‘First Amendment and Supplement to Lease’ which provides for continued use by the City of Shreveport Police Internal Affairs Unit as listed as Appendix A to this document; and

WHEREAS, this resolution would authorize the Mayor to execute an amendment to the lease agreement with Oil & Ale HCB, LLC, to permit the continued use of the space located at 400 Travis, Suite 1412, Shreveport, Louisiana by the City of Shreveport Police Internal Affairs Unit through December 31, 2016; and

WHEREAS, all other terms and conditions of the August 16, 2006 Lease Agreement as amended shall remain in full force and effect.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shreveport in due regular and legal session convened, that the Mayor be and is hereby authorized to execute the ‘First Amendment and Supplement to Lease’ as provided in Appendix “A” for use by the Shreveport Police Department and to execute an agreement between the City of Shreveport and Oil & Ale HCB, LLC, relative to same, the said agreement to be substantially in accordance with the draft hereof which was filed for public inspection with the original of this ordinance in the office of the Clerk of Council on January 24, 2012.

BE IT FURTHER RESOLVED that if any provision of this Resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or application of this Resolution which can be given affect without the invalid provisions, items or application and to this end the provisions of this Resolution are hereby declared severable.

BE IT FURTHER RESOLVED that all resolutions or parts in conflict herewith are hereby repealed.
