Grievance Procedure
Under
The Americans with Disabilities Act
This Grievance Procedure is mandated under the Americans with Disabilities Act of 1990 (the ADA) and Section 504 of the Rehabilitation Act of 1973 (the Rehabilitation Act). The ADA and the Rehabilitation Act prohibit the City from excluding people from participation in its services, programs or activities and facilities based on their disability. The City is prohibited from denying the benefits of such programs or activities, services, accessibility or employment, and from discriminating against such individuals. The ADA and Rehabilitation Act also require a process for grievances relating to disability-based discrimination.
It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits, accessibility, and employment by the City of Shreveport. The State of Louisiana, City of Shreveport, and Caddo Parish’s Personnel Policy governs employment-related complaints of disability discrimination.
The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint will be made available for persons with disabilities upon request.
The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later than 60 calendar days after the alleged violation to:

Within 15 business days after receipt of the complaint, ADA Compliance Officer | Attn: Alonzo Smith or [his] designee will meet with the complainant to discuss the complaint and the possible resolutions. Within 15 business days of the meeting,
ADA Compliance Officer | Alonzo Smith or [his] designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, Braille, or audio tape. The response will explain the position of the [name of public entity] and offer options for substantive resolution of the complaint.
The ADA Coordinator may assist grievant by providing information about the process for disability-based discrimination complaints or facilitating informal resolution when appropriate.
A complaint must be documented and must include a clear statement of the grounds for the complaint.
The ADA Coordinator may explain the complaint process and what information needs to be included in a complaint.
If the response by ADA Compliance Officer | Alonzo Smith or [his] designee does not satisfactorily resolve the issue, the complainant and/or his/her designee may appeal the decision within 15 business days after receipt of the response to the Office of City Attorney/ Assistant City Attorney designee.
Within 15 business days after receipt of the appeal, the Office of City Attorney/Assistant City Attorney designee will meet with the complainant to discuss the complaint and possible resolutions. Within 15 business days after the meeting, the Office of City Attorney/ Assistant City Attorney designee will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.
Reviews and investigations will be conducted confidentially to the greatest extent possible and in compliance with Confidentiality Under ADA Titles II & III, Rehabilitation Act, Civil Rights Act. All participants in the process will be advised of their obligation to maintain confidentiality.
The ADA Coordinator shall maintain all files and records related to the complaints filed pursuant to this grievance procedure. All written complaints received by the ADA Coordinator or her designee as well as all investigation files, evidence and other documents, including those related to requests for reconsideration will be retained for at least three (3) years.
